By accessing or using the Samodrei AI platform, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you must immediately cease all use of the platform and our AI Agents.

2. Professional Use and Compliance

The Site is intended for use by pharmaceutical commercialization professionals. You represent and warrant that your use of the AI Agents (Tele-marketing, Email, Data enrichment) will comply with:

The Federal Food, Drug, and Cosmetic Act (FD&C Act) and FDA regulations.
The CAN-SPAM Act of 2003 and GDPR (General Data Protection Regulation).
All local healthcare advertising laws in the jurisdictions where your outreach is conducted.

3. AI Disclaimer and Limitation of Accuracy

IMPORTANT: Samodrei utilizes large language models and machine learning. You acknowledge that AI-generated content can occasionally be inaccurate, incomplete, or "hallucinated." You are solely responsible for reviewing and vetting all AI-generated scripts, emails, and reports for medical and regulatory accuracy before dissemination.

4. User Data Ownership

You maintain full ownership of all data you upload to the platform. By uploading data, you grant Samodrei a worldwide, non-exclusive license to process, host, and analyze such data solely for the purpose of providing the service to you. You warrant that you have obtained the necessary legal consent from all data subjects (HCPs) included in your uploads.

5. Prohibited Conduct

You may not use the Service to:

Send spam or unsolicited commercial communications.
Infringe upon the intellectual property rights of others.
Attempt to decompile or reverse engineer any software contained on the Site.
Provide medical diagnosis or treatment advice via the AI Agents.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Samodrei Inc. shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or the inability to use the service, including but not limited to regulatory fines, loss of data, or loss of profits.
